Understanding Hennepin County Recycling Requirements
Effective January 1st, 2024, cities within Hennepin County are required to ensure through their garbage hauler licensing program adherence to Minnesota Statute 115A.93, subd. 3(c), that reads: “A licensing authority shall prohibit mixed municipal solid waste collectors from imposing a greater charge on residents who recycle than on residents who do not recycle.” The definition of recycling material includes organics or food waste generated in a home.
The intent of the Statute is to ensure organic recycling is available to everyone within your specific location, while also ensuring the cost of the service is shared by everyone whether they choose to participate or not. This is the same way the current curbside recycling service operates (cans, glass, paper) regarding if a resident opts to not recycle, the fee is not removed due to the State Statue.
